STOLL BERNE Wins Discharge for Surety

On December 22, 2009, the Oregon federal court granted Stoll Berne's motion for summary judgment in a lawsuit against TriMet.

Stoll Berne represents the surety who provided a $3 million letter of credit to guarantee the performance of a Colorado railcar manufacturer on its contract to manufacture railcars for TriMet's Westside Express.  The federal court ruled that the surety was discharged from its obligations as a surety when, without the surety's consent, TriMet and the railcar manufacturer materially altered the terms of their relationship, to the surety's detriment.
