UPS Overcharges Class Action
Stoll Berne has filed a class action complaint against United Parcel Service, Inc. ("UPS") on behalf of persons and entities who have shipped packages with UPS and were subsequently invoiced for shipping charge corrections relating to a package's dimensions.
The lawsuit alleges that, pursuant to an agreement between UPS and its customers, members of the class determine applicable shipping rates by following UPS's strict guidelines based on package weight and dimension. However, prior to delivery, UPS re-measures the package using an imperfect in-motion dimensioning system. That dimensioning system regularly measures a package as being larger than the customer's measurements, even when the customer's measurements are correct. When that happens, and in breach of its agreement, UPS sends an invoice to the customer for the up-charge. Plaintiff seeks to recover monetary damages.
