Timothy S. DeJong

Tim DeJong is a litigator emphasizing intellectual property, complex business, and securities disputes. Tim has experience in litigation matters involving patent infringement, trademark infringement, trade secrets, class actions, violations of state and federal securities statutes, financial fraud, stockbroker malpractice, surety law, ERISA, construction defect, insurance coverage and employment-related disputes.
Tim joined the firm in 1994, after a two-year clerkship with Hon. Robert E. Jones of the United States District Court (Oregon). Tim is knowledgeable about federal court practice and is frequently retained to advise on federal court litigation matters.
Tim is listed in Best Lawyers in America as a top intellectual property litigator and as a "Litigation Star" by Benchmark Litigation. The Portland Business Journal recognized Tim as among the “Best of the Bar” in the field of intellectual property. In 2011, Tim was named to the "Top 50" list of Oregon Super Lawyers.
Outside of work, Tim and his wife are avid travelers and Tim enjoys cooking, Oregon Ducks football and basketball, and collecting vinyl records.
REPRESENTATIVE CASES:
Intellectual Property and Trade Secrets: Tim has represented numerous companies and individuals in all types of intellectual property and trade secrets disputes, involving a wide variety of technologies.
Obtained $1.1 million for Columbia Industries in suit against former engineers for misappropriating trade secrets relating to equipment for oil and gas drilling operations.
Represented Vanguard Products Group in suit involving alarm patents. Previously represented Vanguard Products Group in suit against infringer of patented electronic cord reel management and security system for retail displays and obtained summary judgment of infringement, consent judgment and permanent injunction, and subsequent finding of contempt.
Representing Too Marker Products, a Japanese maker of high-end art markers, in litigation against infringers of its trademarks.
Represented CrossFit in a trademark dispute, which resulted in the plaintiff assigning its registered trademark to CrossFit, dismissing its claims with prejudice and entering into a consent judgment and permanent injunction.
Represented patentee of "short magnum" firearms and ammunition against major firearms and ammunition manufacturers Winchester and Browning. Obtained summary judgment of infringement.
Represented IdaTech in suit against infringer of fuel-cell technology patents.
Represented Columbia Sportswear in a lawsuit against Crocs, after Columbia learned that Crocs had paid a shoe designer employed by Columbia to design shoes for Crocs. Claims included assisting the employee's breach of duty of loyalty and misappropriation of trade secrets.
Represented defendants accused of misappropriating plasma physics trade secrets.
Represented Kershaw in lawsuit against infringer of patents relating to assisted-opening folding knives.
Securities: Tim represents both plaintiffs and defendants in a variety of claims relating to securities and financial fraud, including class actions, institutional investors, individual investors and broker-dealers.
Representing broker-dealer in FINRA customer arbitration.
Represented institutional investor in an opt-out action against American International Group ("AIG") for violation of Oregon Securities Laws, resulting in an $8 million settlement.
Represented investors in Southern Pacific Funding Corp. in securities class action relating to "gain-on-sale" accounting for residual securities, resulting in total recovery of approximately $20 million.
Represented investors in securities class action against Louisiana-Pacific Corp. resulting in total recovery of more than $65 million.
Represented investors in securities class action against Assisted Living Concepts and its auditor resulting in total recovery of more than $40 million.
Represented developer accused of Oregon Securities Law violations in connection with tenancy-in-common ("TIC") interests. Plaintiffs voluntarily dismissed all claims after discovery and while summary judgment was pending.
Business and Commercial Litigation: Tim has represented businesses in a wide variety of industries in disputes ranging from breach of contract to surety law claims.
Representing surety who provided $3 million letter of credit in connection with construction of railcars for TriMet's WES Commuter Rail service. Obtained summary judgment that surety was discharged from its obligations and $3.1 million judgment in U.S. District Court (Oregon) against TriMet.
Represents employers and employees in disputes arising out of non-compete and non-solicitation agreements.
Retained as special litigation counsel to the trustee in bankruptcy of WCI Cable, Inc. to pursue claims against former officers, directors and advisors for causing the company to build an undersea telecommunications system between Alaska and Oregon despite negative feasibility studies.
Represented former employees of Code-A-Phone in class action to recover ERISA funds as a result of a "poison pill" triggered in the course of a hostile takeover.
